Welcome to Tower Crane Rental ("Company," "we," "our," "us"). By accessing or using our services, including renting cranes from us, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before using our services.

1. Services Provided

Tower Crane Rental offers mobile tower crane rental services, including equipment delivery, setup, and on-site support. We are the authorized dealer for Montalift cranes across Kansas, Colorado, Oklahoma, Missouri, and Arkansas.

2. Rental Terms

2.1 Rental Period

The rental period begins on the date of delivery and ends when the crane is returned to or picked up by Tower Crane Rental, as specified in your rental agreement. The standard rental term is weekly or monthly.

2.2 Rental Fees

Rental fees are charged on a weekly or monthly basis at the rate specified in your rental agreement for the selected crane rental. Payment is due in full before delivery.

2.3 Security Deposit

A security deposit will be required for the rental of equipment. This deposit will be refunded upon the return of the crane in good working condition, minus any applicable fees for damages or extended rental periods.

3. Equipment Condition and Use

3.1 Inspection

You agree to inspect the crane upon delivery and report any damages or issues immediately. Failure to report damages within 24 hours of delivery will be considered acceptance of the equipment in good working condition.

3.2 Proper Use

The crane must be operated in accordance with all applicable laws, regulations, and safety standards. You are responsible for ensuring that only qualified and trained personnel operate the crane.

3.3 Maintenance and Repairs

Routine maintenance will be performed by Tower Crane Rental. In the event of equipment failure or damage during the rental period, you must notify us immediately. Any repairs due to misuse or negligence will be billed to the renter.

4. Liability and Insurance

4.1 Liability

You are responsible for any damages, injuries, or losses incurred during the rental period. Tower Crane Rental is not liable for any damage or injury resulting from the improper use of equipment.

4.2 Insurance Requirements

You must maintain adequate liability and property insurance coverage during the rental period. Proof of insurance will be required before the crane is delivered.

5. Cancellation and Early Termination

5.1 Cancellation

Cancellations must be made at least 5 days before the scheduled rental start date. Cancellations made within 5 days may be subject to a cancellation fee.

5.2 Early Termination

If you return the equipment before the agreed rental term ends, you will still be charged for the full rental period unless otherwise agreed upon in writing.

6. Indemnification

You agree to indemnify, defend, and hold harmless Tower Crane Rental, its officers, employees, and agents from any claims, damages, liabilities, or expenses arising out of your use of our equipment, including but not limited to personal injuries, property damage, or breach of these Terms of Service.

7. Force Majeure

Tower Crane Rental is not liable for any failure to perform due to unforeseen circumstances, including but not limited to natural disasters, strikes, or government actions, that make it impossible or impractical to fulfill the rental agreement.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Kansas.

9. Changes to Terms

Tower Crane Rental reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting the updated terms on our website or providing notice to you.
